1. Driving While Intoxicated and Drunk Driving Enforcement Fund Statutes – Consideration of a Draft Final Report recommending modifications to update anachronistic and potentially misleading statutory references in N.J.S. 39:4-50.2, N.J.S. 36:4-50.8, N.J.S. 39:3-10.24, and N.J.S. 12:7-55, in accordance with 1992 and 2009 Reorganization Plans. Report
2. “Surrender” in the Context of Voluntary Relinquishment of Parental Rights – Consideration of a Draft Final Report recommending the replacement of the term “surrender,” in 19 statutes within Title 9 and Title 30, with the term “relinquish” as it relates to the voluntary relinquishment of parental rights. Report
3. N.J.S. 2C:24-4: Constitutionality of Definition of “Portray a Child in a Sexually Suggestive Manner” – Consideration of a Draft Final Report recommending modifications to the definition of “Portray a Child in a Sexually Suggestive Manner” in N.J.S. 2C:24-4, New Jersey’s child endangerment statute, in response to the New Jersey Supreme Court holding in State v. Higginbotham, 257 N.J. 260 (2024). Report
4. New Jersey First Act: Residency Requirement - Consideration of a Draft Final Report proposing modifications to N.J.S. 52:14-7(a) clarifying that the New Jersey First Act’s residency requirement for persons holding an office, employment, or position within state or local government does not extend to unpaid volunteers as held in Kratovil v. Angelson, 473 N.J. Super. 484 (Law Div. 2020). Report
5. Enforcement of Lost Notes – Consideration of an Update Memorandum regarding the project to clarify the language of N.J.S. 12A:3-309 to address the rights of an assignee of an instrument when the original version of the instrument was lost before it was assigned, as discussed in Inv’rs Bank v. Torres, 243 N.J. 25 (2020). Memo
6. Operating Uninsured Automobiles - Consideration of an Update Memorandum summarizing additional research regarding the scope of the term “operating” as used in N.J.S. 39:6A-4.5(a), in light of the holding in Memudu v. Gonzalez, 475 N.J. Super. 15 (App. Div. 2023) and seeking Commission guidance with respect to the continued direction of the project. Memo

News: Welcome Barbara Rivera and JC Demaria
We are pleased to announce that Barbara B. Rivera has joined the New Jersey Law Revision Commission as our new Counsel. Barbara has more than 25 years of experience as an attorney, we look forward to the valuable contributions and insights she will bring to our team. We would also like to announce a belated welcome to JC Demaria who has joined the Commission as our Legislative Law Clerk for the Fall semester.

With the enactment of N.J.S. 1:12A-1 et seq., the current New Jersey Law Revision Commission was created in 1985 and began work in 1987.
The New Jersey Law Revision Commission is required by statute to “promote and encourage the clarification and simplification of the law…and its better adaptation to present social needs, secure the better administration of justice and carry on scholarly legal research and work.” N.J.S. 1:12A-8.
The Commission does so by conducting an ongoing review of New Jersey statutes and case law to identify areas of the law that require revision. The Commission also considers recommendations from the American Law Institute, the Uniform Law Commission (formerly the National Conference of Commissioners on Uniform State Laws) and other learned bodies as well as members of the legal community and the public.
